SECTION

  1. Conduct of proceedings by investigation officers, etc.
  2. Short title and interpretation.

An Act to authorise an investigation officer in the Ministry of Communications to
conduct criminal prosecutions and civil proceedings in respect of matters relat-
ing to posts and telecommunications whether under the Criminal Code or any
other enactment in the High Court.

  1. Conduct of proceedings by investigation officers, etc.

(1) Subject to the provisions of section 174 of the Constitution of the Federal Repub-
lic of Nigeria 1999 (which relates to the power of the Attorney-General of the Federation
to institute, continue or discontinue criminal proceedings against any person in any court
of law), an investigation officer in the Ministry of Communications may conduct prose-
cutions in respect of matters relating to posts and telecommunications under the Criminal
Code or any other enactment.

(2) Any investigation officer may, with the consent of the Permanent Secretary of the
Ministry of communications, conduct civil proceedings under or in connection with any
enactment relating to posts and telecommunications.

(3) As regards conduct of proceedings (whether criminal or civil) in a High Court,
the reference to an investigation officer shall be a reference to such officer who is a legal
practitioner.

  1. Short title and interpretation

(1) This Act may be cited as the Posts and Telecommunications Proceedings Act.

(2) In this Act “investigation officer” includes the Chief Investigation Officer, the
Deputy Chief Investigation Officer and any Senior Investigation Officer in the Ministry
of Communications so appointed by the Federal Civil Service Commission.
